These Terms of Use ("Terms") govern your use of the Brightpage Studios website (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover your use of this website only. If you become a Brightpage Studios client, a separate signed services agreement governs that work, and that agreement controls wherever it says something different from these Terms.

1. Who we are

Brightpage Studios ("Brightpage," "we," "us") designs and builds websites for local service businesses. We operate from Texas.

2. Site content, ownership, and permitted use

Everything on this Site, including its text, layout, design, graphics, and the underlying code, belongs to Brightpage Studios or to the parties who licensed it to us, and is protected by copyright and other intellectual property law. You may view the Site and share a link to it. You may not copy, reproduce, republish, or reuse the Site's design, code, or written content for your own website or for any other commercial purpose without our written permission.

Client photos, business names, and testimonials shown on the Site belong to those clients or are used with their written permission, not to Brightpage.

3. The demo pages are illustrative, not real businesses

Several pages on this Site (shown under a "demos" or similar section) present example websites built for made up businesses in different trades, to show what a finished Brightpage site can look like. These demo businesses are not real. Any name, address, phone number, review, photo, or result shown on a demo page is illustrative only and does not describe an actual business, an actual client, or actual results Brightpage has achieved for anyone. Any resemblance to a real business is coincidental.

This is different from the client case studies and the client testimonial elsewhere on the Site, which describe a real client and a real, completed project.

4. No warranty on site content

This Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non infringement. We do not warrant that the Site will be uninterrupted, secure, or error free, or that any information on it is complete, accurate, or current.

5. Limitation of liability for site use

To the fullest extent permitted by law, Brightpage Studios is not liable for any indirect, incidental, special, or consequential damages, or any loss of profits or data, arising from your use of, or inability to use, this Site, even if we have been advised of the possibility of such damages. Nothing in this Section limits any liability that cannot be limited under applicable law.

6. Third party links

This Site may link to third party websites, including client websites, review platforms, and services we use to operate the Site (for example, Cloudflare and Web3Forms, described in our Privacy Policy). We do not control those third party sites, do not review their content, and are not responsible for their content, their availability, or their own terms and privacy practices. Visiting a linked site is at your own risk and subject to that site's own terms.

7. Contact form submissions create no engagement

Submitting the contact form on this Site, or otherwise messaging us through the Site, is an inquiry only. It does not create a client relationship, a services agreement, or any obligation on either side, and it does not reserve a start date, a price, or a project slot. A client engagement begins only when both parties sign a written services agreement. Until then, nothing you submit through this Site is treated as an offer we have accepted or as a binding commitment of any kind. 8. No professional advice

Nothing on this Site is legal, tax, accounting, or other licensed professional advice. Any general business information on the Site is for general informational purposes only and should not be relied on as a substitute for advice from a licensed professional.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. If unresolved, exclusive venue is the state or federal courts in Brazos County, Texas.

10. Changes to these Terms

We may update these Terms as the Site or our practices change. The date at the top shows when they were last updated. Continued use of the Site after a change means you accept the updated Terms.
